PRIVACY NOTICE FOR OPERATORS AND DRIVERS (VEHICLE DATA)

This notice provides information about the processing of your personal data by the Volvo Group.

The Volvo Group may process personal data about you, if you are or have been an individual, or the employee of a company, that has bought or rented a product or service offered by one of the companies belonging to the Volvo Group. In this case, please read out Customer notice.

If you are or have been an individual, or the employee of a company, that has sold or rented a product or service to one of the companies belonging to the Volvo Group, we might process personal data about you. In this case, please read our Supplier notice.

If you are or have been the driver of a vehicle, or the operator of a construction machine, sold or produced by one of the companies belonging to the Volvo Group, we might process personal data about you. In this case, please read our Driver notice.

If you are or has been employed by a Volvo Group company or has been engaged as a consultant, we may process personal data about you. In this case please read our Employee or Consultant notice.

Vehicle generated data

 

If data generated from the vehicle could be connected to you as an individual, such data would be considered to be personal data. VOLVO will process the following categories of personal data generated from the vehicle. Please note that VOLVO will not necessarily process all the data listed below.

 

Driver behaviour and performance, such as driving pattern; instantaneous geo-positioning data and location data, language settings of the dashboard

 

Vehicle Identification number, such as the vehicle-ID (including VIN and chassis ID), IP number, MAC address 

 

Vehicle Performance data, such as technical vehicle data, information from vehicle components, battery usage, engine data, fuel consumption, power/torque data, fault codes

 

Vehicle Usage data, such as brake usage, gear shifting, acceleration/deceleration, dashboard settings, power/torque utilization, technical data generated from the engine; the detection of road and ambient conditions data with time stamps and operating hours 

 

Environmental data, such as road conditions, ambient conditions

 

Legal basis and purposes of the processing 

VOLVO’s legitimate interests

 

VOLVO is constantly aiming to develop, manufacture and offer leading and innovative products and services. Through continuous evaluation and analysis of data from vehicles operating in the field, VOLVO is able to develop and enhance our products and services. Therefore, the vehicle generated data will be processed by VOLVO in order to:

 

  • perform research and development to enhance and maintain the current products, services and to develop new products and services; 
  • determine road qualities, types and conditions and to understand outer environmental effects of the vehicles based on position of the vehicle; 
  • solve quality issues on vehicles; 
  • perform accident research investigations; 
  • manage warranty;
  • manage product liability claims; 
  • perform contract or regulatory compliance surveillance;
  • perform proactive maintenance and diagnostics. 

 

Provide advice to customers on products and services which might be suitable to them, having regard to the performance and use of their vehicles 

 

The vehicle generated data will be processed by VOLVO based on its legitimate interest of performing such processing. VOLVO’s legitimate interest includes the interest to manage its daily operations in relation to safety issues and warranty and product liability issues. Further, VOLVO’s legitimate interest includes the interest to enhance its products and services based on data of their current functionality. 

 

Legal obligation

VOLVO may process data generated from the Vehicle’s engine in order for VOLVO to comply with the type approval regulations in EU Directive 2007/46/EC and other applicable legal obligations.

VOLVO will obtain your personal data from the vehicle either interactively over the wireless network (via e.g. the telematics gateway) or through the use of diagnostic tools, e.g. Tech Tool via cable.

VOLVO will normally not share your personal data with anyone outside of the Volvo Group, unless required by law or regulation. However, VOLVO may, if necessary to fulfill the purpose for processing the personal data, share your personal data with other Volvo Group company, including company outside of the European Union or the European Economic Area EU/EEA. VOLVO may also, if necessary to fulfill the purpose for processing the personal data, share your personal data with third party companies and suppliers including companies and suppliers outside the EU/EEA.

VOLVO will secure that appropriate safeguards are in place which provide adequate levels of protection of your personal data as required by applicable data protection laws. For example, this may include the use of intercompany or external data processing agreements based on EU approved Standard Contractual Clauses or EU-US Privacy Shield or such other mechanisms as have been recognized or approved by the relevant authorities from time to time. Data connected to a certain vehicle will be processed for the entire expected life of the vehicle type, which could be up to 25 years.

You have the right to request from VOLVO information about the personal data processed about VOLVO and access to such personal data. You also have a right to request rectification of your personal data if this is incorrect and request erasure of your personal data. Further, you have a right to request restriction of the processing of your personal data meaning that you request VOLVO to limit its processing of your personal data under certain circumstances. There is also a right for you to object to the processing based on legitimate interest or processing for direct marketing. You have as well the right to data portability (transfer of your personal data to another controller) if VOLVO’s processing if your personal data is based on consent or contractual obligation and is automated.

 

You also have the right to lodge any complaints you may have regarding VOLVO’s processing of your personal data to a supervisory authority. For more information about these rights and how to exercise them, please contact the VOLVO data protection officer.
